By accessing or using Presenz (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms apply to all visitors, users, and others who access the Service. Presenz is a product of JDV Labs.

2. Eligibility

You must be at least 13 years of age to use Presenz. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service. Users between 13 and 17 must have parental consent for account creation.

3. Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activities that occur under your account.

4. Subscription and Payment

Presenz offers free and paid subscription tiers. Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in our refund policy. You may cancel your subscription at any time; access continues through the end of the current billing period.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Use automated tools to scrape, crawl, or abuse the Service
• Impersonate another person or entity
• Upload harmful, offensive, or infringing content
• Circumvent any usage limits or restrictions

6. Intellectual Property

The Presenz platform, including its content, features, and functionality, is owned by JDV Labs and protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works from our platform without express written permission.

Your session recordings and transcripts remain your property. You grant us a limited license to process them for the purpose of delivering the Service to you.

7. AI-Generated Content

Presenz uses artificial intelligence to generate coaching feedback, interview questions, and scenario content. This content is provided for educational purposes only and does not constitute professional career, legal, medical, or psychological advice. We do not guarantee the accuracy or completeness of AI-generated content.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE SPECIFIC OUTCOMES FROM USING PRESENZ, INCLUDING BUT NOT LIMITED TO JOB OFFERS, ACADEMIC ADMISSIONS, OR PERFORMANCE IMPROVEMENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JDV LABS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your account for violation of these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the applicable jurisdiction. Disputes shall be resolved through binding arbitration, except where prohibited by law.
